Terms & Conditions - Budgeting Work
Ovation Production Accounting is a trading name of ALMACK Productions Ltd
1. Scope of Work
All budgeting services will be delivered in accordance with the package agreed (e.g. Essentials or Centre Stage). A full scope will be outlined in your engagement letter and agreed before work begins.
2. Client Responsibilities
You agree to provide accurate, complete, and timely information as required for the preparation of the budget. The accuracy and relevance of the final budget are dependent on the quality of the information you supply.
You are solely responsible for reviewing the budgets and ensuring they are suitable, fit for your intended purpose, and free from errors. Ovation Production Accounting will not be liable for any consequences arising from the use of budgets that have not been thoroughly reviewed by you.
3. Delivery Format
Budgets will be delivered as view-only documents until final payment is received. Editable versions will be released once the full fee is paid.
4. Turnaround Time
Delivery timelines will begin upon receipt of all required information. Delays in supplying information may result in adjusted timelines.

6. Intellectual Property & Licensing
All materials created remain the intellectual property of Ovation Production Accounting until full payment is received. Upon full payment, you are granted a non-exclusive, non-transferable licence to use the materials for internal production planning only. Materials may not be resold, repackaged, or distributed without written permission.
7. Limitation of Liability
Budgets are forward-looking estimates and rely on variables that may change. While all care is taken, Ovation Production Accounting makes no guarantees as to actual costs, financial outcomes, or commercial success. Ovation Production Accounting shall not be liable for any indirect, incidental, or consequential loss arising from use of the budget, nor for any loss arising from incorrect or incomplete information supplied by the client nor for any loss arising from errors in spreadsheet formulas or other such IT issues. It is YOUR responsibility to ensure the budgets are accurate, appropriate and fit for the intended purpose. You accept that Ovation Production Accounting are in no way liable for any actions / consequences taken as a result of the budgeting work and expressly waive any right to Ovation Production Accounting paying any form of damages or any such similar items as a result of our work.
8. Confidentiality
All client information will be treated confidentially and will not be shared with third parties without written consent, except as required by law. We reserve the right, for the purpose of promotional activity, training or for other business purposes, to mention that you are a client. As stated above we will not disclose any confidential information
9. Changes to Scope
Significant changes to the production plan (e.g. new cast size, additional venues) may require re-scoping of the work and a revised fee. Minor updates and revisions are included within the original scope unless otherwise agreed.
10. Communication
Unless you instruct us otherwise we will communicate with you via email, telephone and instant messaging (eg. Whatsapp). The recipient is responsible for virus checking emails and any attachments. With electronic communication there is a risk of non-receipt, delayed receipt, inadvertent misdirection or interception by third parties. We use virus-scanning software to reduce the risk of viruses and similar damaging items being transmitted through emails or electronic storage devices.However electronic communication is not totally secure and we cannot be held responsible for damage or loss caused by viruses nor for communications which are corrupted or altered after despatch. Nor can we accept any liability for problems or accidental errors relating to this means of communication especially in relation to commercially sensitive material. These are risks you must bear in return for greater efficiency and lower costs.
11. Termination
Either party may terminate the agreement at any time. However, work completed up to that point will be invoiced proportionally. Deposits are non-refundable once work has commenced.

- A deposit (typically 30%) is required to begin work.
- The remaining balance will be invoiced in stages as agreed.
- Payment is due within 7 days of the invoice date.
- Late payment may result in paused work or withholding of deliverables.
